These Terms of Service ("Terms") govern access to the website, portfolio, and the provision of software consultancy and development services by Pathfinder Analytics ("Company," "we," "us," or "our") to you ("Client," or "you"). By engaging our services, submitting project requirements, or using our website, you agree to be bound by these Terms.

1. Portfolio & Consultancy Services

Pathfinder Analytics acts as a software consultancy and development agency, providing a digital portfolio to showcase our engineering capabilities. We offer custom software development, systems architecture, and infrastructure consulting services. We reserve the right to accept or decline project engagements based on team capacity, project scope, and technical feasibility.

2. Client Responsibilities & Submissions

To ensure accurate scoping and high-quality delivery, the Client is strictly responsible for:

• Accuracy of Requirements: Providing complete and accurate project briefs, functional specifications, and clear business requirements.
• Intellectual Property: Ensuring you hold the legal rights, licenses, or copyrights for any content, assets, or third-party services provided for integration into your project.
• Access & Credentials: Clearly detailing environment access, API keys, and infrastructure requirements prior to development commencing.
• Milestone Approvals: Thoroughly reviewing and officially approving deliverables, staging builds, or design mockups before we proceed to the next development phase.

3. Quotations, Scope & Rates

Project quotations are based on the specific scope complexity, requested technologies, and projected timeline at the time of issuance. Quotes are subject to change due to scope adjustments, third-party service costs, or if the Client alters the requirements after the initial estimate. Quotes do not include third-party licensing fees, hosting costs, or taxes unless explicitly stated.

4. Quality Assurance & Liability

Pathfinder Analytics is committed to delivering high-quality software aligned with your approved specifications. Our liability is structured around industry development standards.

• Bug Resolution: We operate within standard commercial support windows for identifying and resolving defects as agreed upon during the project scoping phase.
• Limitation of Liability: Our liability for defective deliverables is strictly limited to the repair or correction of the specific affected functionality, provided it is reported within the agreed warranty period.
• Force Majeure: We are not liable for delivery delays caused by acts of God, third-party service outages, or governmental actions.

5. Payment & Project Terms

Unless otherwise agreed in a master services agreement, payment for discovery or scoping work must be cleared prior to commencement. For development engagements, a standard non-refundable deposit is required before work begins, with the remaining balance due per agreed milestones and before the final handover of deliverables or source code.

6. Governing Law & Jurisdiction

These Terms and any dispute arising from our consultancy services or website shall be governed by and construed in accordance with the laws of the jurisdiction in which Pathfinder Analytics' primary office or headquarters is located, without giving effect to any choice or conflict of law provisions.
